Mindit Consulting S.R.L., acknowledges the importance of the confidentiality in terms of the personal data of our website visitors. This Confidentiality Policy („the Policy”) sets out the basis on which we manage and store the personal information that we collect on our website https://mindit.ro („Website”).

The new European Regulation in terms of the protection of the personal data consists in the Regulation 2016/679/EU of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as “The Regulation”) and repealing Directive 95/46/EC (General Data Protection Regulation).

The contractual obligation will be designed according to how the verification process is carried out that would require the transmission of the data to the Controller’s contractual partners.The data will be transmitted to the contractual partners only if they provide they comply with the data processing obligation and the implementation of adequate technical and organizational measures. ‍

The Personal Data Storage Period
If the data subject requests information in connection with the services provided by our company, the data will be stored during the communication period, for the purpose of providing a reply to your request and afterwards for a period of maximum 3 year since their collection. Following the expiry of such storage period, all personal data will be permanently deleted. ‍

The Rights of the Data Subjects
In connection with the processing of the Personal Data and based on the conditions specified by the Regulation on data protection, you may exercise any of the following rights:
– The right of access to the personal data concerning you: you may request that you will be communicated the categories of personal data that are processed, the purpose of the processing, the recipients to whom they have been or will be disclosed, the envisaged for which they will be stored or, if not possible, the criteria used to determine that period; the existence of an automated decision-making, including profiling;
– The right to rectification or update when the data are inaccurate or incomplete throughout the processing and before the issue of the final report; if there are errors related to your processed data, you may request their rectification; if the data are incomplete, you may request their completion. The rectification will be communicated to each recipient to whom such data were disclosed, unless it proves impossible or involves disproportionate efforts;
– The right to erasure of data under certain circumstances (e.g. when the personal data are no longer necessary in relation to the aforementioned purposes): you may request the erasure of the processed data, if such data are no longer necessary in relation to the purposes for which they were collected or processed, if you withdrew your consent and there is no other legal ground for the processing; if you object to the processing and there are no overriding legitimate grounds for the processing; the personal data have been unlawfully processed; the personal data have to be erased for compliance with a legal obligation; the personal data have been collected in relation to the offer of information society services;

The role of this notice consists in explaining how your personal data are used and the purpose for which they are used, prior to the commencement of the data processing, in any of its forms. ‍

The purpose of the personal data collection and processing: The purpose of your personal data collection and processing consists in carrying out all the verifications for the purposes of certifying the information submitted by you in your application form or CV, registered by Controller and for the purposes of carrying out anonymous statistics. ‍

The legal ground of the personal data processing is represented by:
– the art. 29 in the Labour Code, as subsequently amended and supplemented;
– decision no. 355/2007 on the health surveillance of workers;
– your consent granted as per the art. 6 in the EU Regulation 2016/679 of the European Parliament and of the Council on the Personal Data Protection;
– the code of ethics or the professional by-laws;
– the lawful interest arising from the risk management. ‍

The verification of the professional skills represents an instrument in favour of the employer by means of which the employer may verify, prior to signing of the individual employment agreement, whether the potential employee has professional and behaviour-related skills compatible with the employer’s professional, cultural and vision needs.

Types of personal data and recipients:
The types of data that may be collected and processed: surname; first name; email address; phone number; date of birth; home or residence address; data related to professional experiences; data related to the professional training; information arising from study documents, criminal record, data arising from the candidate’s CV, recommendations from the places of work, information obtained from former employers, information obtained from current employers, as well as data arising from media sources and social media with professional/ educational profile.

The categories of recipients which the data are conveyed to:
Your personal data are conveyed to the institutions mentioned in the CV or application form, as well as to the representatives of the employer companies or institutions; to the institutions issuing the documents conveyed for verification purpose; to the persons to which they have been conveyed as contact persons of the institutions/ companies, former employers, natural persons or legal entities proposed by the candidate for recommendations.

Neither third party has access to your data, except for when there is a legal or contractual obligation. The contractual obligation will be designed according to how the verification process takes its course, which requires the conveyance of the data by the Controller’s contractual partners. ‍

The Preservation of the Personal Data:
The data that Mindit Consulting S.R.L collects and processes as per the agreement of services for the verification of the candidates’ professional profiles are translated into the verification report, and the documents are stored for 3 years after completing the verification. The report will be stored pseudonymized, so that it is protected from the security point of view. After the storage period expires, all your personal data and final report will be permanently deleted.

The provision of inaccurate information may result in the postponement of the employment within the company, the withdrawal of the employment offer or even the termination of the employment agreement with the Employer Company.

The rights as to your personal data:
As to the processing of the Personal Data and under the conditions specified in the EU Regulation on Personal Data Protection no. 679/2016, you may exercise any of the following rights:
– The right of access to your personal data;
– The right to request the rectification or the update when the data are inaccurate or incomplete, etc. throughout the processing and before the preparation of the final report;
– The right to request the erasure of the data under certain circumstances (e.g. when the personal data are no longer required in relation to the aforementioned purposes);
– The right to request the restriction of the processing under certain circumstances;
– The right to lodge a complaint with the competent data protection authority;
– The right to oppose to the processing;

Mindit Consulting S.R.L., recunoaste importanta confidentialitatii datelor personale ale vizitatorilor website-ului nostru. Aceasta Politica de confidentialitate („Politica”) stabileste baza pe care gestionam si stocam informatiile personale pe care le colectam pe website-ul nostru, https://mindit.ro („Website”)

Noua reglementare europeana in materia protectiei datelor cu caracter personal o reprezinta Regulamentul 2016/679/UE al Parlamentului European si al Consiliului din 27 aprilie 2016 privind protectia datelor cu caracter personal ale persoanelor fizice in ceea ce priveste prelucrarea datelor cu caracter personal si privind libera circulatie a acestor date (in continuare “Regulamentul”) si de abrogare a Directivei 95/4/CE (Regulamentul General privind protectia datelor). Politica noastra de confidentialitate prezinta principiile si masurile luate pentru asigurarea conformitatii prelucrarii datelor conform regulamentului. In calitatea sa de Operator, societatea Mindit Consulting S.R.L., prelucreaza in ceea ce va priveste, urmatoarele categorii de date cu caracter personal: nume; prenume; adresa de e-mail; numar de telefon; informatii transmise de catre persoana vizata prin intermediul solicitarii.

Modalitatea prelucrarii datelor personale despre Dvs de pe website
– Daca descarcati anumite articole sau materiale de pe website-ul nostru sau alte tipuri de continut de afaceri cu privire la produsele si serviciile noastre, vom colecta adresa de e-mail.

Categoriile de destinatari catre care se transmit datele sunt ‍‍
Datele dumneavoastra cu caracter personal sunt stocate si pastrate in baza noastra de date, aferenta website-ului companiei. Niciun tert nu are acces la datele dumneavoastra, cu exceptia cazului in care exista o obligatie legala sau contractuala.
Obligatia contractuala va fi proiectata in functie de modul de derulare a procesului de verificare, care ar necesita transmiterea datelor catre partenerii contractuali ai Operatorului. Transmiterea datelor catre partenerii contractuali se va realiza doar daca acestia asigura respectarea obligatiei de prelucrare a datelor si implementarea de masuri tehnice si organizatorice adecvate. ‍

Perioada de stocare a datelor cu caracter personal
In cazul in care persoana vizata solicita informatii in legatura cu serviciile oferite de compania noastra, datele vor fi stocate pe perioada comunicarii, in vederea oferirii unui raspuns la solicitarea dumneavoastra, și ulterior, pentru o durata de maxim 3 ani de la data colectarii. Dupa expirarea perioadei de stocare, toate datele cu caracter personal vor fi sterse definitiv.

Drepturile persoanelor vizate ‍‍
In legatura cu prelucrarea Datelor cu Caracter Personal si in baza conditiilor specificate Regulamentul privind protectia datelor, va puteti exercita oricare dintre urmatoarele drepturi:
– Dreptul de acces la datele personale care va privesc: puteti solicita sa vi se comunice categoriile de date cu caracter personal care sunt prelucrate, scopul in care are loc prelucrarea, destinatarii carora le-au fost sau vor fi comunicate, perioada pentru care se preconizeaza ca vor fi stocate sau, daca acest lucru nu este posibil, criteriile utilizate pentru a stabili aceasta perioada; existenta unui proces decizional automatizat incluzand crearea de profiluri;
– Dreptul de a solicita rectificarea sau actualizarea atunci cand datele sunt inexacte sau incomplete, pe perioada prelucrarii si inainte de intocmirea raportului final: in situatia in care exista erori cu privire la datele care va sunt prelucrate, aveti posibilitatea de a solicita corectarea lor; in cazul in care datele sunt incomplete, puteti solicita completarea lor. Rectificarea va fi comunicata fiecarui destinatar la care au fost transmise datele, cu exceptia cazului in care acest lucru se dovedeste imposibil sau presupune eforturi disproportionate;
– Dreptul de a solicita stergerea datelor în anumite circumstante (de ex. cand datele personale nu mai sunt necesare in raport cu scopurile mentionate mai sus): puteti solicita stergerea datelor prelucrate, daca datele nu mai sunt necesare pentru indeplinirea scopurilor pentru care au fost colectate sau prelucrate, daca v-ati retras consimtamantul si nu exista niciun alt temei juridic pentru prelucrarea; daca va opuneti prelucrarii si nu exista motive legitime care sa prevaleze in ceea ce priveste prelucrarea; datele cu caracter personal au fost prelucrate ilegal; datele cu caracter personal trebuie sterse pentru respectarea unei obligatii legale; datele cu caracter personal au fost colectate in legatura cu oferirea de servicii ale societatii informationale;
– Dreptul de a solicita restrictionarea prelucrarii in anumite circumstante: aveti dreptul de a solicita restrictionarea prelucrarii datelor in urmatoarele situatii: daca ati contestat exactitatea datelor, pentru o perioada care ne permite sa verificam exactitatea datelor; daca prelucrarea este ilegala, iar dvs va opuneti stergerii datelor cu caracter personal, solicitand in schimb restrictionarea utilizarii lor; daca operatorul nu mai are nevoie de datele cu caracter personal in scopul prelucrarii, dar le solicitati pentru constatarea, exercitarea sau apararea unui drept in instanta; daca v-ati opus prelucrarii pentru intervalul de timp in care se verifica daca drepturile legitime ale operatorului prevaleaza asupra drepturilor dvs;
– Dreptul de a va opune prelucrarii: aveti dreptul sa va opuneti prelucrarii datelor dvs daca ele privesc marketingul direct. Totodata, va puteti opune prelucrarii, cu exceptia cazului in care operatorul demonstreaza ca are motive legitime care justifica prelucrarea si care prevaleaza asupra intereselor, drepturilor si libertatilor dvs sau ca scopul este constatarea, exercitarea sau apararea unui drept in instanta;
– Dreptul de a va retrage consimtamantul, in orice moment, pentru prelucrarea datelor care va privesc printr-o cerere transmisa la adresa de e-mail operations@mindit.ro;
– Dreptul la portabilitatea datelor Dvs., in sensul transferului datelor dvs. personale catre un alt operator de date personale desemnat de dumneavoastra;
– Dreptul de a nu face obiectul unei decizii bazate exclusiv pe prelucrarea automatizata a datelor: Dvs nu veti face obiectul unei decizii bazate exclusiv pe prelucrarea automatizata a datelor.

Aceasta politica de confidentialitate poate fi actualizata din cand in cand, de exemplu in urma modificarii legislatiei relevante. J40/13070/2021 CUI RO31079854, colecteaza si proceseaza datele personale, în conformitate cu prevederile Regulamentului European nr. 679/2016. ‍
Rolul prezentei informari este de a explica modul în care datele dumneavoastra personale sunt utilizate si scopul în care acestea sunt folosite, anterior initierii operațiunilor de prelucrare de date, in oricare dintre formele sale.

Scopul colectarii si procesarii datelor cu caracter personal: Scopul colectarii si procesarii datelor dumneavoastra cu caracter personal este de a întreprinde toate verificările în vederea certificarii informației prezentate de catre dumneavoastra în formularul de aplicație sau în CV, înregistrate de catre Operator si pentru a realiza statistici cu caracter anonim. ‍

Temeiul legal al prelucrării datelor cu caracter personal este reprezentat de:
– art. 29 din Codul Muncii, cu modificarile si completarile ulterioare;
– hotararea nr. 355/2007 privind supravegherea sanatatii lucratorilor; -consimtsmantul dumneavoastra acordat în temeiul art. 6 în Regulamentul UE 2016/679 al Parlamentului European si al Consiliului privind Protectia Datelor cu Caracter Personal;
– cod de etica sau statut profesional;
– interes legitim care rezulta din managementul riscului. Verificarea aptitudinilor profesionale constituie un instrument în favoarea angajatorului prin care acesta sa poata verifica, anterior incheierii contractului individual de munca, daca potentialul angajat are calitatile profesionale si abilitatile comportamentale compatibile cu necesitatile profesionale, de cultura si viziune a angajatorului.

Tipuri de date cu caracter personal si destinatarii:
Tipurile de date care pot fi colectate si procesate: nume; prenume; adresa de e-mail; numar de telefon; data de nastere; adresa de domiciliu sau de reședinta; date referitoare la experiente profesionale; date referitoare la formarea profesionala; informatii rezultate din acte de studii, cazier judiciar, date rezultate din CV-ul candidatului, recomandari de la locurile de munca, informatii obtinute de la fostii angajatori, informatii obtinute de la actualii angajatori precum si date rezultate din surse media si social media cu profil profesional/educational. ‍

Categoriile de destinatari catre care se transmit datele sunt:
Datele dumneavoastra cu caracter personal se transmit institutiilor mentionate în CV sau formularul de aplicare, precum si reprezentantilor institutiilor sau a companiilor contractoare; institutiilor emitente ale actelor transmise spre verificare; persoanelor transmise ca persoane de contact ale institutiilor/companiilor, fostilor angajatori, persoanelor fizice sau juridice propuse de catre candidat pentru recomandari. Niciun tert nu are acces la datele dumneavoastra, cu exceptia cazului în care exista o obligatie legala sau contractuala. Obligatia contractuala va fi proiectata în functie de modul de derulare a procesului de verificare, care ar necesita transmiterea datelor catre partenerii contractuali ai Operatorului. ‍

Pastrarea datelor cu caracter personal:
Datele pe care Mindit Consulting S.R.L le colecteaza si prelucreaza în temeiul contractului de prestari servicii de verificare a profilurilor profesionale ale candidaților sunt transpuse în raportul de verificare, iar documentele sunt stocate pe o perioada de 3 ani de la finalizarea verificarii. Pastrarea raportului se va realiza intr-un format pseudonimizat, astfel incat sa fie protejat din punct de vedere al securitații. Dupa expirarea perioadei de stocare, toate datele dvs cu caracter personal si raportul final vor fi sterse definitiv.

Furnizarea de informatii incorecte poate sa rezulte în amanarea angajarii in cadrul companiei, retragerea ofertei de angajare sau chiar încetarea contractului de munca cu Compania Angajatoare. ‍

Drepturile în ceea ce priveste datele dumneavoastra cu caracter personal:
În legatura cu prelucrarea Datelor cu Caracter Personal si în baza conditiilor specificate Regulamentul privind protecția datelor la nivel european nr. 679/2016, va puteti exercita oricare dintre urmatoarele drepturi:
– Dreptul de acces la datele personale care va privesc;
– Dreptul de a solicita rectificarea sau actualizarea atunci cand datele sunt inexacte sau incomplete, pe perioada prelucrarii si inainte de intocmirea raportului final;
– Dreptul de a solicita stergerea datelor in anumite circumstante (de ex. cand datele personale nu mai sunt necesare în raport cu scopurile mentionate mai sus);
– Dreptul de a solicita restrictionarea prelucrarii in anumite circumstante;
– Dreptul de a depune o plangere la autoritatea competenta privind protectia datelor;
– Dreptul de a va opune prelucrarii;
– Dreptul de a va retrage consimtamantul, în orice moment, pentru prelucrarea datelor care va privesc printr-o cerere transmisa la adresa de e-mail operations@mindit.ro
– Dreptul de a fi uitat, in sensul adresarii unei solicitari pentru stergerea evidentelor datelor personale;
– Dreptul la portabilitatea datelor dvs., in sensul transferului datelor dvs. personale catre un alt operator de date personale desemnat de dumneavoastra;
– Dreptul de a fi notificat în caz de încalcari privind securitatea datelor, de catre operator.
